1. OBJECT

The purpose of the present general terms and conditions is to define the terms and conditions of distance selling, from order to payment and delivery, between:
JILL SAS, a simplified joint stock company with share capital of 4 500 000 euros, with its head office in Echirolles, France, and registered in the Trade and Companies Register under the number 529 179 384.

We operate a retail business, through a website connected to the Internet, selling products to private persons. The general terms and conditions regulate all the steps necessary to place the order and ensure that the latter is tracked between the contracting parties. The order implies irrevocable acceptance of the general terms and conditions which manifests itself through the checking of a box. The general terms and conditions can be subject to modifications, as such the applicable conditions are those in force on the website on the date your order is placed.

You declare that:
- You have the capacity to enter into the present agreement
- You are not purchasing products with the aim of reselling them
- You are not a retailer

2. PRODUCTS AND PRICES

The products offered for sale are those which feature on the website www.marese.com, on the day you consult the website.

Products are offered for sale while stocks last. Products shown as available on the website are effectively physically reserved for the needs of the sales made on the website. When products are shown as being unavailable, this is temporarily the case. In the event of permanent unavailability, the products are withdrawn from the e-commerce website. 
Photographs reproduced on the website illustrating the products offered for sale, reproduce the products as faithfully as possible. You are invited to consult the description of each product in order to know its detailed characteristics.

Prices are shown in euros inclusive of all taxes (including therefore the VAT applicable on French territory on the day of order) and excluding delivery charges which remain payable by you except for in particular conditions. The handling and delivery costs are indicated at the time of order, before your final validation.   They can also be consulted in the  SHIPPING COSTS, DELIVERY TIMES AND CONDITIONS section of the general terms and conditions.

We reserve the right to, at any time, add new products, delete part or all of the products sold or presented on the site, change their presentation and modify their prices. Products will be invoiced on the basis of the prices in force at the time the order is registered.

3. ORDER

When you wish to place an order, you select the different product(s) that you want by clicking on "add to basket". 

Before placing your order, you declare that you have read and irrevocably accepted the present general terms and conditions by checking the relevant box. A summary of your order will also be available enabling you to validate the identity of the products ordered and the desired quantity. You must then accurately enter the information necessary to identify yourself for the invoicing and delivery of the order. Once all this information has been entered and confirmed, you definitively validate your order by clicking on the "validate" button.

Confirmation of the shopping basket contents and of the order shall constitute an irrevocable commitment on your part which can only be reneged on in the limited number of cases specified by these present conditions, and in particular by the exercise of the customer's right of withdrawal (see Return and Exchange clause). This validation shall have the same legal value as a handwritten signature.

Any order represents the express and irrevocable acceptance of the prices and descriptions of the products on sale. The order is therefore deemed firm and final and can only be cancelled with our consent and on terms that shall indemnify us against any loss or damage resulting from this cancellation. In the event that the product ordered is unavailable, you will be informed of this and the sums paid will be refunded as soon as possible and no later than 14 days from payment of the said sums.

If you already have a customer account, you must log in. If you are a new customer, you must complete the fields provided in order to create your customer account and thus provide your contact details. 

Once your order has been registered, you will receive an e-mail confirming that www.marese.com has acknowledged your order. Acknowledgement of the order does not mean that it has been accepted. We reserve the right to block an order for any reason whatsoever (temporary unavailability of the product, existing dispute with the customer, non-payment, etc.). We have 5 working days to find a solution and to keep you informed of the action taken in respect to your order. 

In general, it is expressly agreed that e-mails shall be considered proof between the parties, as are the automatic saving systems used on the website, notably with regard to the nature and date of the order, except where you can provide evidence to the contrary.

4. PAYMENTS AND ITS SECURITY

Payment shall be made online by bank card. CARTE BLEUE, VISA, MASTERCARD, by Paypal, or by MaxiChèque (Cadhoc) online gift vouchers. Payment of the total price must be made in full at the time of ordering. 
With the MERCANET system operated by BNP Paribas, JILL SAS has chosen a highly secure tool which guarantees that you can pay online securely and with complete confidence.
When validating your order, provide your bank card number, its expiry date and the last 3 numbers of the security code on the back of your card. Various authorisation servers are then accessed in order to verify the data and prevent any misuse and fraud. To this end, the server is encrypted and all the information circulated is encrypted (Netscape's SSL protocol). Nothing is transmitted unencrypted over the Internet. We have opted for the "3D secure" option in order to strengthen the security of payments. After entering your bank card details, an extra step will redirect you to your bank's page where you will be asked to provide additional information: date of birth or single-use dynamic code sent by SMS.

An invoice is produced for each order and sent to you by e-mail. It is also available to view on the website.

The delivery note will be inserted inside the package containing the product(s) ordered. Should an incident arise during the registration of the order, this will be null and void and you will have to place the order again.

5. SHIPPING COSTS, DELIVERY TIMES AND CONDITIONS

The delivery area is metropolitan France, Corsica and the following European countries: Austria, Belgium, Denmark, Germany, Italy, Luxembourg, Netherlands, Portugal and Spain.

Except in the case of force majeure or the article being unavailable, the average delivery time is 4 to 5 working days following the date of order for a delivery in France and 7 to 8 working days following the date of order for a delivery in Europe. JILL SAS shall not be held liable in the case of late delivery for reasons relating to strikes, to a blockage of the means of transport, and to bad weather. In the event of a significant delay, we undertake to compensate you by bearing the delivery charges of your next purchase.

At the time of order, you must carefully enter the delivery address and provide a telephone number (as well as door code, floor, etc. if relevant). This information is confidential and you are solely responsible in the event of errors in the delivery details provided making it impossible to deliver the order.

When placing the order, you are required, for a delivery in France, to select a mode of delivery and the associated shipping costs.
- Delivery to a Marèse or Ooxoo store (see the list on the website): shipping costs are FREE
- Delivery to a Relais Colis® outlet: shipping costs are 6 euros.
- Delivery to home or place of work: shipping costs are 8 euros. 

For a delivery in Europe:
- Delivery to a Marèse or Ooxoo store (see the list of partners on the website). ONLY possible in BELGIUM and LUXEMBOURG: shipping costs are 10 euros.
- Home delivery in Europe (for all of the countries cited previously): shipping costs are 15 euros.

We reserve the right to choose the carrier and guarantee the smooth delivery of the product(s), based on the information you have provided to us. 

You must check the contents of the package and the condition of its packaging before opening the package. Any dispute concerning the shipment (damage during shipment, damaged packaging, package opened, etc.) must be systematically reported by the consignee on the delivery note or otherwise within 24 hours to the carrier. This written report of the carrier is essential for a potential application for a refund.

In the case where the consignee does not collect their package within the given time frame (8 days after shipment) the products will be returned to JILL SAS who reserves the right to refund the prices of the articles, aside from the shipping costs which remain payable by you.

6. RETURN AND EXCHANGE

In accordance with Article L 121-20 et seq of the French Consumer Code, you have 14 clear days to exercise your right of withdrawal without having to pay any penalties, except for the cost of returning the product(s). This 14 day period starts from the date of receipt of the order. After expiry of this period, the delivered product(s) shall be deemed to be accepted.

The article(s) must be returned within the 14 days. The article(s) must be complete in the case of a set or detachable elements. The article(s) can have been tried on but not worn for any length of time, nor washed. The article(s) must imperatively be accompanied by a delivery note and the invoice, or by copies of these documents available on the website, in order to facilitate the processing of your return and to accelerate the refund.

We reserve the right to refuse any return that does not comply with the above-mentioned conditions.

The customer shall bear all the risks and charges associated with the return. Any initial shipping costs will be refunded, in accordance with the legislation in force. No later than 14 following days the receipt and checking of the returned article(s), the refund will be effected by re-crediting the customer's bank card.

In the case of an exchange for a product of equal value, no refund will be effected and the desired product will be sent. In the case of an exchange for a cheaper product, the price difference will be re-credited on the bank card used to make the original payment. No exchange will be possible for an article of greater value.

In the event that the delivery does not conform to the order, the provisions on the return of the product described above shall apply.  We will endeavour to deal with this nonconformity as a matter of urgency and we will bear the costs of return and reshipment of the product.

 

7. RIGHT OF RETURN


If you ordered on the Internet and wish to exercise your right of cancellation, please complete and send the form to contact@marese.com. The right of withdrawal is exercised in accordance with our terms and conditions. A receipt will be immediately sent by mail. Our customer service will contact you.

8. GUARANTEE

All of our products are covered under the legal guarantee scheme, provided that their use has been normal and the care advice has been followed, in accordance with Articles L 211-1 et seq of the French Consumer Code. Personal information must be provided in the context of distance selling, as it is necessary for the processing, the delivery of the orders and the drawing up of invoices. This information is however strictly confidential and JILL SAS guarantees its confidentiality.

All the text, photos, etc. that make up the pages of this website cannot be the object of any representation or reproduction, in whole or in part, on any medium whatsoever, without the express prior authorisation of JILL SAS. 

The trademarks and logos featuring on this website are registered. Their total or partial reproduction, using elements of this website, is strictly prohibited and will result in prosecution. 

11. LIABILITY

In all stages of access to the website, the ordering process, delivery and subsequent services, JILL SAS has an obligation of means.

JILL SAS shall not be held liable in the case where the breach of contract stems from an unforeseeable and insurmountable act of a third party, from any inconvenience or damage inherent in the use of the Internet network (service interruption, outside intrusion, presence of computer viruses, etc.) or from any event deemed force majeure, in accordance with jurisprudence.

12. TOTAL PERIOD FOR WHICH THE OFFER AND PRICE REMAIN VALID

The present terms and conditions apply for the duration of the online services provided by JILL SAS, and are liable to change.

In the event that one of the clauses of the present contract is rendered null and void due to a change in legislation or regulation or by a court decision, this shall not in any way affect the validity of and compliance with the other clauses of the present general terms and conditions.

For the seller, refraining from invoking one of the clauses of the present general terms and conditions shall not in any way constitute a waiver of its right to invoke it in the future, nor indeed a waiver of its right to invoke any other clause.

13. SOCIAL PLUG-INS

The buttons and spaces displaying Facebook content can appear on other websites in order to create a more "social" experience. The websites that you access do not receive any of your information. The content of these social plug-ins comes directly from Facebook,

When you click on "Like" or write a comment using a social plug-in, your activity is published on Facebook and shown to your Facebook friends, who can view the plug-in on the same website. The things that you like can also appear on your profile (you can control this parameter in the Background information section).

14. LAW APPLICABLE

All issues relating to the present general terms and conditions as well as the sales that they govern, which cannot be dealt with by the present contractual stipulations, shall be governed by French law. The parties agree that the present general terms and conditions shall be subject to French law.
